POSSESSION NOTICE (for immovable property)
[Under Rule- 8(1) of Security Interest (Enforcement) Rules, 2002] Whereas: The undersigned being the Authorised Officer of the Indian Bank. under the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act and in exercise of powers conferred under section 13(12) read with rule 3 of the Security Interest (Enforcement) Rules, 2002 issued Demand Notice dated 29.04.2025 calling upon the Borrower & Mortgagor M/s. JMG Signature Prop. Mr. Jayesh Ganatra & Guarantor and Mortgagor Mrs. Priya Ganatra to repay the amount mentioned in the notice being Rs. 57,58,329.02 (Rupees Fifty Seven Lakhs Fifty Eight Thousand Three Hundred Twenty Nine Only) along with interest thereon within 60 days from the date of receipt of the said notice.
The Borrower having failed to repay the amount, notice is hereby given to the borrower and the public in general that the undersigned has taken possession of the property described herein below in exercise of powers conferred on him under section 13(4) of the said Act read with rule 8 & 9 of the said rules, on this 30th of June 2025.
The Borrower in particular and the public in general is hereby cautioned not to deal with the property and any dealings with the property will be subject to the charge of the Indian Bank for an amount of Rs. 57,58,329.02 (Rupees Fifty Seven Lakhs Fifty Eight Thousand Three Hundred Twenty Nine Only) and interest and other charges thereon from date of demand notice
We draw attention to the provisions of section 13(8) of the SARFAESI act and the Rules framed there under which deals with your rights of redemption over the securities.

[सुरक्षा व्याज (अंमलबजावणी) नियम, 2002 च्या नियम- 8(1) अंतर्गत] तर: खाली स्वाक्षरी केलेले भारतीय बँकेचे अधिकृत अधिकारी आहेत. सिक्युरिटायझेशन अँड रिकन्स्ट्रक्शन ऑफ फायनान्शिअल ॲसेट्स अँड इनफोर्समेंट ऑफ सिक्युरिटी इंटरेस्ट ॲक्ट अंतर्गत आणि सिक्युरिटी इंटरेस्ट (अंमलबजावणी) नियम, 2002 च्या नियम 3 सह वाचलेल्या कलम 13(12) अंतर्गत प्रदान केलेल्या अधिकारांचा वापर करून, 29.04.2025 ची मागणी नोटीस जारी केली ज्याने कर्जदार/मोर्टला बोलावले. नोटीसमध्ये नमूद केलेली रक्कम परत करण्यासाठी JMG स्वाक्षरी प्रॉपर श्री जयेश गणात्रा आणि हमीदार आणि गहाणखत सौ. प्रिया गणात्रा रु. ५७,५८,३२९.०२ (रुपये पन्नास लाख अठ्ठावन्न हजार तीनशे एकोणतीस फक्त) त्यावरील व्याजासह ती नोटीस मिळाल्यापासून ६० दिवसांच्या आत.
कर्जदाराची रक्कम परतफेड करण्यात अयशस्वी झाल्यामुळे, याद्वारे कर्जदाराला आणि सामान्यत: जनतेला नोटीस देण्यात आली आहे की, या 30 जून 2025 रोजी या कायद्याच्या कलम 13(4) अन्वये त्याला दिलेल्या अधिकारांचा वापर करून खाली वर्णन केलेल्या मालमत्तेचा अधोस्वाक्षरीने ताबा घेतला आहे.
विशेषत: कर्जदाराला आणि सामान्यत: जनतेला याद्वारे सावध केले जाते की मालमत्तेचा व्यवहार करू नये आणि मालमत्तेशी कोणताही व्यवहार केल्यास भारतीय बँकेच्या शुल्काच्या अधीन असेल रु. ५७,५८,३२९.०२ (रुपये पन्नास लाख अठ्ठावन्न हजार तीनशे एकोणतीस फक्त) आणि डिमांड नोटिसच्या तारखेपासून त्यावरील व्याज आणि इतर शुल्क
आम्ही SARFAESI कायद्याच्या कलम 13(8) च्या तरतुदींकडे आणि तेथे तयार केलेल्या नियमांकडे लक्ष वेधतो ज्या अंतर्गत सिक्युरिटीजवरील तुमच्या पूर्ततेच्या अधिकारांशी संबंधित आहेत.
